These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions, and by participating, all entrants will be deemed to have accepted and be bound by the Terms and Conditions.
1. The Promoter
Essity UK Ltd [Reg no, 03226403, whose registered address is: Southfields Road, Dunstable, Bedfordshire, LU6 3EJ] (The Promoter). This competition is not endorsed, sponsored or administered by Facebook, nor is Facebook associated with this competition.
2. Eligibility
This competition is open to residents of the United Kingdom (England, Scotland, Wales and Northern Ireland) aged 16 or over and who work within the hospital setting and are familiar with the materials for cast applications only. This competition specifically excludes for employees of the Promoter, their immediate families, affiliates, agents or anyone else who may be professionally connected with this Promotion.
a) To be eligible to enter this competition, the entrant must be currently employed as a recognised healthcare practitioner.
b) No purchase necessary, and any purchase made does not increase chances of winning.
3. Promotional period
Bonfire Night Themed Hospital Cast Off Competition is open for entries between 00:00 3rd September 2024 and 16:59 on 6th November 2024.
4. How to enter the competition
To enter, participants are required to submit a photograph of their casting creation, which is to be based on the topic of the competition. The photograph should be sent to hcmarketing@essity.com. Alternatively, it may be sent via private message in Facebook messenger to the Delta-Cast Facebook page (https://www.facebook.com/DeltaCast.UK/). All entries must include the name of the artist, place of work, and contact details. Hospital Departments are permitted to make multiple submissions. Please do not submit any photographs that may identify a patient. Please also ensure you have the full permission and consent from colleagues for any photographs that are submitted.
5. Judging
Entries will be judged by, and the winner chosen by, an Essity employee, not associated with any account management responsibilities for the orthopaedic therapy area. The criteria will include, but not be limited to, creativity of the design, how this relates to the topic and attention to detail. The judging will take place within 2 weeks of the closing date. Winners have 5 days to respond to the initial message requesting their address. If Essity receives no response within 5 days, the winner forfeits their prize and a new winner will then be chosen. Entries received after closing date will not be included in this competition. Essity maintains the right to close or change the status of the review function in circumstances beyond their control. The winners will be announced at our educational webinar on the 7th November and then notified via Facebook messenger or email on, or before, the 7th November 2024. Address details will be requested by Essity in order to receive the prize.
6. Prize details
Prizes are intended to be used in the workplace and are not for personal gain. The prizes are as follows. 1st prize a life size skeleton, 2nd prize a joint model set, 3rd prize anatomy poster bundle. Prizes will either, be delivered to the winners by the Essity Account Manager or posted to the place of work. At the discretion of Essity, prizes will be dispatched up to 28 days after the winner receives confirmation of winning and has submitted their details. Essity holds no responsibility for any delivery delays.
7. Disqualification
The Promoter reserves the right at its sole discretion to disqualify any individual found to be attempting to tamper with the operation of the competition, setting up multiple accounts, using multiple identities or to be acting in any manner deemed by the Promoter to be in violation of the terms and conditions; or to be acting in any manner deemed by the promoter to be disruptive. Incomplete or illegible requests and those which do not satisfy the requirements of these Terms and Conditions in full will be disqualified and will not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means, that person’s requests will be disqualified, and any sample award will be void. Bulk entries made from trade, agencies, consumer groups or third parties will not be accepted and will be disqualified. Multiple entries are acceptable, but each entrant will only be eligible to win once throughout the promotional period.
8. Entry/content
As used herein, Content means any text, likeness or other material or information you provide to The Promoter.
Entrants agree that:
a) All information that you submit about yourself and/or your team, place of work and department is accurate and up to date;
b) The Content you submit is original and was created by you and/or your team in your place of work.
You further agree that you shall not submit any Content:
a) That is known by you to be false, inaccurate or misleading;
b) That infringes any third party’s copyright, patent, trademark, trade secret, rights of publicity, rights of privacy, moral rights or any other applicable personal or proprietary rights;
c) That encourages or advocates any unlawful or unauthorized behaviour or activity or violates any law, statute, ordinance or regulation
d) That is offensive, obscene, vulgar, or is inappropriate for a public, family-friendly environment;
e) That is, or may be considered to be, defamatory, libellous, hateful, racially or religiously biased or offensive, threatening or harassing to any individual or entity;
f) That includes any information that references other websites, addresses, email addresses, contact information or phone numbers; or
g) That contains any computer viruses, worms, Trojan horses or other potentially damaging computer programs or files.
The Promoter reserves the right, but not the obligation, to:
a) Monitor or review the Content you have submitted;
b) To remove or refuse to post any Content submitted that The Promoter deems in its sole discretion to be inappropriate or violate any of these Terms and Conditions without giving you notice.
By entering the promotion, prize winners acknowledge that their entry becomes and remains the property of the promoter and they may be required to participate in publicity relating to the promotion. Consent would be granted by the winner but will come without payment. Such publicity may include, without limitation, the entrant's name and/or, statements made by the entrants concerning the Promotion and photographs taken as part of the Promotion
9. General
Entrants will require a Facebook and Facebook messenger account if the entrant wants to submit their entry via Facebook messenger. Unless otherwise agreed in writing by the Promoter, prizes will only be awarded directly to the winners. Names cannot be amended. It is the responsibility of the winner to provide their correct, up-to-date details at the time of acceptance in order for their prize to be processed. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance.
The Promoter is not responsible or liable for:
I. any submissions that are lost or delayed due to faulty, failed or erroneous electronic data transmissions
II. communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines satellites, servers, computers or providers utilised in any aspect of this promotion causing delays or disruption
III. claims which are lost, delayed, corrupted, damaged, misdirected, or incomplete or cannot be delivered for any technical, delivery or other reason. Proof of posting will not be accepted as proof of receipt. Inaccessibility or unavailability of the internet
IV. In the event of exceptional circumstances outside its reasonable control and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these Terms and Conditions at any stage but will always endeavour to minimize the effect to participants in order to avoid undue disappointment
The Promoter cannot accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims suffered by participants as a result of registering. The Promoter further disclaims liability for any injury or damage to you or any other person relating to the sample
The Promoter reserves the right to substitute the prize, in part or whole, with an alternative of equal or greater value in the event of circumstances beyond its control.
The decision of the Promoter shall be final and binding in all promotional matters.
This Promotional Offer is governed by English Law and entrants submit to the exclusive jurisdiction of the English and Welsh courts
If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
The Promoter reserves the right to modify or terminate these Terms and Conditions for any reason, without notice, and without liability to you, or any third party. You are responsible for regularly reviewing these Terms and Conditions so that you are apprised of any changes
10. Data Protection
Any personal data relating to participants will be used solely in accordance with current data protection legislation and will only be used in the administration of the promotion unless they consent to receive marketing communications. Personal data will solely be used to send out the winner’s prize and deleted thereafter. Personal data will not be held or used in future marketing promotions and will not be disclosed to a third party without the individual’s prior consent.
